U.S. Army v. LT (0-2)
Our client was accused of and received a GOMOR for assaulting another officer who she was dating. The interesting thing about this case is the fact that no one would have known about the allegation if she had not reported that her intimate partner was assaulting and abusing her. Rather than use critical thinking skills, the Command assisted by their legal advisors, chose to give her a GOMOR on the word of her ex- boyfriend and his friend. They failed to identify the fact that both individuals were lying about what really happened. Our review of the CID interviews noted very obvious inconsistencies in their stories. Yet, despite those inconsistencies, our client received an officially filed GOMOR and faced separation. After she received the GOMOR, she brought us on board to represent her.
The key to this case was discovery. When our client responded to the GOMOR she did not have access to the evidence used against her. Once we came onto the case, we immediately asked for the full case file. We had to fight for it but eventually we obtained the file allowing us to critically analyze the evidence against her. We drafted an in-depth legal review highlighting the deficiencies in the evidence. Our client also pursued a social media campaign. Ultimately the Commanding General opted to retain her after reading her matters provided by us.
In this case our client did not merit a board because she was a probationary officer, and
the Command was NOT seeking an other than honorable discharge. This was one of
those rare occurrences where we were able to secure victory on the strength of the
paper and evidence we provided to the Commanding General.
